1. Acceptance of Terms

These Terms and Conditions (the "Terms") govern your access to and use of the AI-powered recruiting platform operated by PT Dibimbing Digital Indonesia ("Rekom", "we"), accessible through rekom.ai, app.rekom.ai, and all derivative products and services (the "Platform").

These Terms are made under and subject to the laws of the Republic of Indonesia, including but not limited to:

• Law No. 27 of 2022 on Personal Data Protection
• Law No. 11 of 2008 as amended by Law No. 19 of 2016 on Electronic Information and Transactions (the ITE Law)
• The Indonesian Civil Code (KUH Perdata) as it relates to agreements
• Other relevant laws and regulations

2. Definitions

In these Terms, the following expressions have the meanings set out below:

3. Accounts & Registration

3.1 Registration Requirements

To use the Rekom Platform, you must:

• Be at least 18 (eighteen) years old
• Have the legal capacity to enter into a binding agreement
• Provide registration information that is accurate, complete, and current

As a Company User, you must also:

• Use the Platform for legitimate professional recruiting purposes
• Have authority to represent your company, if registering on its behalf

As a Candidate User, you must also:

• Register for yourself, not on behalf of or impersonating another person
• Ensure the profile data and CV you provide are truthful and do not mislead prospective employers

3.2 Account Security Responsibilities

You are fully responsible for:

• Keeping your password and account credentials confidential
• Limiting account access to authorised parties and, for Candidate Users, not sharing your account with anyone
• Promptly reporting any unauthorised access to your account at admin@rekom.ai
• All activity occurring under your account, whether carried out by you or by others you permit

3.3 Multi-User Accounts (Company Users)

If your subscription plan allows more than one team member, the account administrator is responsible for ensuring every additional user complies with these Terms. Rekom may suspend the account if any user within it commits a breach.

3.4 Candidate User Accounts

A Candidate User account is personal to one individual and is non-transferable. Rekom provides this account free of charge, and you are not required to subscribe in order to use job search, the CV builder, or the application tracker.

You may stop using the Platform and request deletion of your account at any time at admin@rekom.ai. If you only want to stop being discoverable by Company Users without closing your account, see the profile withdrawal mechanism in Privacy Policy section 10. The full deletion procedure — including for individuals who never registered an account — is in Privacy Policy section 11.

4. Rekom Services

4.1 Description of the Service

Rekom provides an artificial-intelligence-powered recruiting platform that lets HR teams search for candidates using natural language, receive automatic candidate match scores, manage shortlists, and monitor the recruiting pipeline — all within one integrated platform.

The main features for Company Users include:

• Natural Language Search — searching for candidates using plain-language descriptions
• AI Match Scoring — automatic scoring of candidate fit against your stated criteria
• Ask AI About Talent — asking the AI specific questions about a candidate's profile
• Shortlist & Pipeline Management — managing selected candidates and recruiting status
• Smart Automatic Filters — filters set intelligently by the AI based on search context
• Southeast Asia Coverage — access to candidate data across the Southeast Asian region

The main features for Candidate Users include:

• AI-powered job search — finding roles in everyday language, with an explanation of why they fit
• Candidate profile — a professional profile that Company Users can discover
• CV builder — building a CV from your profile data, including tailoring it to a specific role and exporting to PDF
• Application tracker — saving roles and recording your own application statuses

4.2 Service Availability

Rekom strives to keep the Platform highly available. However, we do not guarantee that the Platform will be available 100% of the time without interruption. Scheduled maintenance will be announced in advance where possible. Rekom is not liable for losses arising from unavailability of the Platform beyond our control, including third-party infrastructure outages.

4.3 Development and Feature Changes

Rekom actively develops the Platform. We may add, change, or discontinue particular features at any time. For material changes to paid plans, we will give Users reasonable notice.

5. Subscription & Payment

5.1 Plans

Rekom offers several access plans, including a free trial and paid plans. Pricing details, the features available on each plan, and subscription periods can be found on the rekom.ai/en/pricing page.

5.2 Free Trial

Rekom provides a free trial period for new Users on the terms applicable at the time of registration. Rekom may change the duration or conditions of the free trial at any time. During the trial, access to certain features may be limited compared with paid plans.

5.3 Payment Terms

• Payment for paid plans is made in advance according to the billing cycle you select (monthly or annual)
• Listed prices include applicable taxes (including VAT under Indonesian tax rules) unless stated otherwise
• All payments are processed through secure, certified payment service providers
• Rekom may change prices by giving at least 30 (thirty) days' notice before the change takes effect

5.4 Automatic Renewal

Paid subscriptions renew automatically at the end of each subscription period unless you cancel before the renewal date. Users may cancel at any time through account settings on the Platform or by contacting our team.

5.5 Refund Policy

Given the digital nature of Rekom's services, we generally do not provide refunds for a subscription period already underway. However, in particular circumstances that Rekom considers reasonable (such as a demonstrated billing error), a refund may be considered at our discretion. To make a request, contact hello@rekom.ai within 7 (seven) days of the billing date.

Rekom may suspend or terminate your account unilaterally and without prior notice if these use terms are breached.

7. Content & User Data

7.1 Ownership of User Data

You retain full ownership of all data you enter into the Platform ("User Data"), including your search history, the shortlists you create, recruiting notes, and your pipeline information. Rekom claims no ownership over your User Data.

7.2 Candidate User Profiles and CVs

The professional profile and CV you build as a Candidate User belong entirely to you. Rekom claims no ownership over them, does not sell them, and does not hand them to third parties beyond what is described in the Privacy Policy.

By completing your profile, you consent to it being discoverable and viewable by Company Users through the candidate search feature. You may withdraw this consent at any time through the mechanism in Privacy Policy section 10, without affecting your access to other features.

CVs you produce with the CV builder can be downloaded and used freely, including to apply for roles outside the Platform.

7.3 Licence Granted to Rekom

By using the Platform, you grant Rekom a limited, non-exclusive, revocable licence to use your User Data solely to:

• Provide, operate, and improve the Platform's services
• Produce aggregated and anonymised statistics and analytics
• Comply with applicable legal obligations

7.4 Responsibility for Content

You are solely responsible for the accuracy, legality, and appropriateness of the content you enter into the Platform. Rekom is under no obligation to verify or monitor User-generated content.

7.5 Data Export

You may export your User Data from the Platform while your account is active. After an account is terminated, Rekom is under no obligation to retain User Data for more than 90 (ninety) days.

8. Candidate Data & Recruiting Obligations

8.1 Nature of Candidate Data

Candidate data available on the Platform comes from two sources: profiles completed by Candidate Users who register at talent.rekom.ai, and data gathered from publicly available sources and data partners holding a valid legal basis. Rekom acts as a facilitator connecting HR teams with relevant candidate profiles.

8.2 Your Obligations Regarding Candidate Data

This section applies to Company Users. By accessing candidate data through the Platform, you undertake to:

• Use candidate data only for legitimate recruiting purposes connected to the role you are recruiting for
• Not distribute, sell, or share candidate data with unauthorised third parties
• Not use candidate data for purposes unrelated to recruiting
• Respect candidate privacy and not contact them outside a professional recruiting context
• Comply with all applicable employment and data protection laws and regulations
• Not discriminate against candidates on the basis of legally protected characteristics

8.3 Accuracy of Candidate Data

Rekom works to keep candidate data accurate and current, but cannot guarantee that all information available on the Platform is accurate, complete, or up to date. Users are advised to verify candidate information independently before making recruiting decisions.

9. Intellectual Property

9.1 Rekom's Ownership

All intellectual property rights in the Platform — including but not limited to the AI technology, search algorithms, interface design, software code, trademarks, logos, and documentation — belong exclusively to PT Dibimbing Digital Indonesia or its licensors. Nothing in these Terms transfers that intellectual property to you.

9.2 Licence Granted to Users

Subject to your compliance with these Terms and any required payment, Rekom grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your internal recruiting purposes.

9.3 Restrictions

You may not copy, modify, distribute, sell, rent out, or create derivative works from the Platform or any component of it without Rekom's prior written permission.

9.4 Feedback

If you provide input, suggestions, or feedback to Rekom about the Platform ("Feedback"), you hereby grant Rekom an unrestricted, royalty-free, perpetual right to use that Feedback for any purpose without obligation to you.

10. Confidentiality

Each party undertakes to keep confidential the confidential information it receives from the other party in the context of using the Platform. "Confidential Information" covers business data, recruiting strategy, technology, and other information that should reasonably be understood as confidential.

These confidentiality obligations do not apply to information that:

• Has become publicly available other than through a breach of these Terms
• Was already known to the receiving party before disclosure
• Was lawfully received from a third party with no obligation of confidence
• Was independently developed without using the other party's Confidential Information
• Must be disclosed under binding law or court order

11. Disclaimer of Warranties

In particular, Rekom does not warrant that:

• The Platform will always be available, uninterrupted, secure, or error-free
• AI search results will always be accurate, complete, or suited to your specific needs
• The candidate data available on the Platform is always current and accurate
• Using the Platform will result in a successful hire
• The Platform is free of viruses or other harmful components

12. Limitation of Liability

In no event shall Rekom's total cumulative liability to you for all claims arising from or in connection with these Terms or your use of the Platform exceed the lesser of:

• The total fees you paid to Rekom in the 12 (twelve) months preceding the claim, or
• IDR 5,000,000 (five million Rupiah)

This limitation of liability applies even if Rekom has been advised of the possibility of such loss, and represents a fundamental allocation of risk between the parties.

13. Indemnification

You agree to release, defend, indemnify, and hold harmless Rekom, including its directors, employees, agents, and partners, from and against all claims, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or in connection with:

• Your use of the Platform in breach of these Terms
• Your infringement of any third party's rights, including privacy or intellectual property rights
• Content you entered into the Platform
• Recruiting decisions you made based on data from the Platform
• Your breach of applicable law or regulation

14. Termination

14.1 Termination by the User

You may stop using Rekom's services at any time by cancelling your subscription through account settings and/or by contacting our team. Termination does not entitle you to a refund for a subscription period already underway, unless otherwise determined.

14.2 Termination by Rekom

Rekom may suspend or terminate your account, with or without prior notice, if:

• There is a suspected or proven breach of these Terms
• Your use is judged to threaten the security, integrity, or reputation of the Platform
• There is a payment failure left unresolved after notice
• It is required by law or a competent authority

For non-material breaches, Rekom will endeavour to give notice and an opportunity to remedy before terminating.

14.3 Effect of Termination

Once an account is terminated, your access to the Platform ends immediately. Provisions that by their nature should survive termination — including those on intellectual property, disclaimer of warranties, limitation of liability, indemnification, and dispute resolution — remain in force.

15. Changes to the Service & Terms

15.1 Changes to the Terms

Rekom may change these Terms from time to time. Changes will be notified to you by email and/or through an in-Platform notice at least 14 (fourteen) days before they take effect, except for changes driven by urgent legal obligations.

Your continued use of the Platform after the effective date constitutes your acceptance of the updated Terms. If you do not agree to a change, you may terminate your subscription before it takes effect.

15.2 Changes to the Service

Rekom may change, add to, or discontinue Platform features at any time. For material discontinuation of features on paid plans, Rekom will give reasonable notice and, where appropriate, offer an alternative or a suitable price adjustment.

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms and all legal relationships arising from or connected with them are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.

16.2 Resolution by Deliberation

If a dispute, disagreement, or difference of opinion (a "Dispute") arises between you and Rekom in connection with these Terms or your use of the Platform, the parties agree to first attempt to resolve it amicably by deliberation and consensus within 30 (thirty) calendar days of one party giving written notice of the Dispute.

16.3 Resolution by Arbitration or the Courts

If amicable resolution does not succeed within that period, the Dispute will be resolved through:

• Arbitration before the Indonesian National Board of Arbitration (BANI) under its applicable arbitration rules, with proceedings conducted in Indonesian and seated in Jakarta, or
• If the parties do not agree to arbitration, before the South Jakarta District Court as the agreed competent court

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with Rekom's Privacy Policy and other legal documents referenced here, constitute the entire agreement between you and Rekom on the subject matter covered, and supersede all prior agreements or understandings — whether written or oral — on the same matter.

17.2 Severability

If any provision of these Terms is held invalid, ineffective, or unenforceable by a competent court, that provision will be treated as severed from these Terms while the remaining provisions stay in full force.

17.3 No Waiver

Rekom's failure to enforce any right or provision of these Terms will not be treated as a waiver of that right or provision. A waiver is effective only if made in writing and signed by an authorised officer of Rekom.

17.4 Assignment

You may not assign your rights or obligations under these Terms to any other party without Rekom's prior written consent. Rekom may assign its rights and obligations under these Terms to an affiliate or in the context of a merger, acquisition, or sale of assets, on notice to you.

17.5 Force Majeure

Rekom is not liable for any failure or delay in performing its obligations caused by circumstances beyond its reasonable control, including but not limited to natural disasters, civil unrest, war, widespread internet infrastructure disruption, or government action.

17.6 Language

These Terms were drawn up in Indonesian. This English text is a translation provided for convenience only.
